Effective Date: February 10, 2026
By hiring TerraMark Lawn & Landscape (“TerraMark,” “we,” “us,” or “our”), the customer (“Client,” “you,” or “your”) agrees to the following Terms of Service.
By accepting any estimate, quote, proposal, invoice, or by allowing service to be performed (whether verbally, electronically, or in writing), the Client acknowledges that they have read, understood, and agreed to these Terms of Service in full.
Acceptance of any estimate or service constitutes full agreement to all policies outlined herein.
TerraMark Lawn & Landscape provides professional landscaping services, including but not limited to:
Lawn maintenance
Aeration
Weed control
Seeding
Sod installation
Lawn fertilization
Mulch installation
Pine needle installation
Hedge trimming
Leaf removal
Brush clearing
Property clean-up
Landscape edging
Planting and softscape installation
Patios
Retaining walls
Walkways
Pressure washing
Mosquito treatment
Services are performed as outlined in the written estimate, invoice, or service agreement. Any additional services requested outside the original scope may result in additional charges.
Estimates are based on conditions visible at the time of inspection.
Pricing may change if site conditions differ from what was disclosed or reasonably observable.
Written estimates are valid for 30 days unless otherwise stated.
Payment is due within 10 days of the invoice date unless otherwise agreed in writing.
Accepted forms of payment include:
Check
Credit card
Debit card
Approved electronic payment methods
Cash is not accepted.
Returned checks may result in additional bank or administrative fees.
If payment is not received within the stated payment period, the following late fees will apply based on the number of days past due from the invoice date:
10 days past due: Late fee equal to 15% of the outstanding invoice balance
15 days past due: Additional late fee equal to 15% of the outstanding invoice balance
20 days past due: Additional late fee equal to 20% of the outstanding invoice balance
Late fees are cumulative.
Late fees are applied to offset administrative costs, scheduling disruption, and collection efforts related to unpaid balances.
Accounts 30 days or more past due may have services suspended until payment is made in full.
Client agrees to be responsible for reasonable collection costs, court costs, and attorney’s fees where permitted by law.
TerraMark reserves the right to suspend or terminate services for:
Nonpayment or repeated late payments
Unsafe or hazardous working conditions
Violation of these Terms of Service
Outstanding balances must be paid in full prior to service reinstatement.
One-time services must be canceled at least 24 hours in advance.
Recurring services require 7 days’ notice for cancellation.
Missed service visits due to denied access (locked gates, unsecured pets, blocked work areas) may result in a service charge.
Services may be delayed or rescheduled due to weather conditions, equipment issues, or other circumstances beyond TerraMark’s control.
TerraMark is not responsible for delays caused by weather, natural events, or circumstances outside its control.
Client agrees to:
Provide safe and clear access to the property
Secure pets during service visits
Remove toys, debris, hoses, decorations, pet waste, and obstacles prior to service
TerraMark is not responsible for delays or damage caused by unmarked, hidden, buried, or obstructed items.
TerraMark is not responsible for damage to:
Unmarked sprinkler systems
Invisible fencing
Wiring
Drainage lines
Underground utilities
Client is responsible for identifying and marking all underground items prior to service.
Products are applied according to manufacturer instructions and applicable regulations.
TerraMark is not responsible for turf or plant damage caused by drought, disease, pests, poor soil conditions, improper watering, or failure to follow post-treatment care instructions.
Results may vary and are not guaranteed unless specifically stated in writing.
Lawn and landscaping results depend on environmental factors including weather, soil conditions, watering practices, and existing turf health. TerraMark does not guarantee specific results unless stated in writing.
TerraMark’s liability is limited to the amount paid for the specific service provided.
TerraMark shall not be liable for indirect, incidental, special, or consequential damages.
Any claims for damage must be reported within 48 hours of service completion.
Client grants TerraMark permission to photograph the property before and after services for documentation and marketing purposes unless written notice is provided opting out.
This Agreement shall be governed by and interpreted in accordance with the laws of the state in which the services are performed.
TerraMark Lawn & Landscape reserves the right to update or modify these Terms of Service at any time. Updated terms will apply to future services.
These Terms of Service constitute the entire agreement between TerraMark Lawn & Landscape and the Client.
Any modifications must be made in writing and agreed to by both parties.
